Terms of Service
Effective: August 28, 2026
These Terms are an agreement between you and FoodTrekNow, operated by Kevin Lisenby ("FoodTrekNow," "we," "us," or "our"). They govern your use of FoodTrekNow websites, mobile applications, customer ordering features, vendor tools, and location opportunity marketplace.
1. Agreement to these Terms
By creating an account, placing an order, starting a vendor trial, or otherwise using FoodTrekNow, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
You must be legally capable of entering into this agreement. If you use FoodTrekNow for a business, you represent that you are authorized to bind that business.
2. Accounts and security
Provide accurate, current information and keep it updated. You are responsible for activity under your account and for protecting your password and devices. Notify us promptly if you believe an account is compromised. We may require email verification, identity verification, or additional information to protect the service.
Guest checkout may be available for some orders. Guest users remain responsible for providing accurate pickup and contact information.
3. FoodTrekNow's platform role
FoodTrekNow provides technology that helps independent food truck businesses publish menus, accept orders and payments, communicate with customers, manage pickup, and connect with independent location hosts and event organizers. Each participating vendor—not FoodTrekNow—is the seller and preparer of its food and is responsible for its menu, pricing, taxes, operating status, ingredients, allergens, food safety, licenses, order fulfillment, and customer service.
Location hosts and event organizers are responsible for the accuracy of addresses, dates, attendance estimates, available facilities, fees, permits, access, setup instructions, cancellation terms, and their authority to offer a property or event. Vendors must independently evaluate each opportunity and remain responsible for licenses, insurance, travel, staffing, food supply, and operating decisions. Unless a separate feature expressly states otherwise, FoodTrekNow does not collect or hold opportunity fees or deposits.
Booking confirmations, messages, routes, ratings, and profitability estimates are planning tools. Attendance, sales, profit, availability, suitability, safety, and performance are not guaranteed. A profitability score is based on host-supplied information and general assumptions, not financial advice or a promise of income.
We do not guarantee that a vendor, item, host, opportunity, location, schedule, preparation time, or service will always be available, accurate, suitable, or error-free.
4. Customer orders and payments
- Review the vendor, items, quantities, instructions, price, taxes, fees, pickup location, and contact information before submitting an order.
- Prices and availability may change until checkout is completed. Sold-out items cannot be ordered.
- Customer payment is processed by Stripe through the selected vendor's connected Stripe account. FoodTrekNow does not collect customer order proceeds for itself.
- An order is not accepted until the service confirms it. A vendor may reject or cancel an order when an item is unavailable, the truck closes, payment fails, fraud is suspected, or fulfillment is not reasonably possible.
- Estimated preparation and pickup times are estimates, not guarantees.
Food allergies and dietary needs
Vendors prepare food in environments that may use common allergens. Menu descriptions and special instructions do not guarantee an allergen-free meal or prevent cross-contact. Contact the vendor directly before ordering if you have a food allergy or serious dietary restriction.
5. Cancellations, refunds, and vendor credits
Cancellation availability depends on the order's status. An order generally cannot be canceled after preparation begins unless the vendor agrees or applicable law requires otherwise. When the service offers a choice, an eligible cancellation may result in either:
- a refund to the original payment method, subject to payment-network processing time; or
- a credit issued by that specific food truck for a future eligible order.
Vendor-specific credits have no cash value, cannot be transferred to another truck or user, and may be applied only through FoodTrekNow to the issuing vendor. Credits may be adjusted or removed if issued in error, obtained through abuse, or connected to a reversed transaction. These Terms do not limit rights provided by applicable law.
6. Additional vendor and host terms
Vendors must maintain accurate business, menu, price, availability, tax, location, and operating information; hold required licenses, permits, insurance, and food-safety credentials; comply with applicable food, employment, tax, privacy, and consumer laws; promptly manage orders and customer communications; and honor valid refunds or credits.
Hosts must provide truthful property and opportunity information, have authority to invite vendors, disclose all vendor charges and material restrictions before booking, keep capacity current, and comply with applicable property, zoning, event, fire, health, accessibility, tax, and permit requirements. Vendors and hosts are responsible for honoring confirmed arrangements and any cancellation policy they accept.
Live truck location sharing is optional and off by default. A vendor who starts sharing confirms that the device is associated with the food truck's current business operations, that the vendor is authorized to publish that location, and that sharing will be stopped when it is no longer appropriate. Vendors and hosts must not expose a person's private residence or precise location without authorization.
Vendors and hosts authorize FoodTrekNow to display the business, location, opportunity, menu, photo, message, and review content they submit and grant us a worldwide, nonexclusive, royalty-free license to host, reproduce, format, and display that content solely to operate and promote the service. They retain ownership of their content and represent that it is accurate, lawful, and authorized.
Vendor payment onboarding, customer charges, payouts, refunds, and identity verification are provided through Stripe. Vendors must comply with Stripe's applicable agreements and are responsible for payment disputes, chargebacks, taxes, and payout-account accuracy.
7. Vendor subscription and 14-day trial
- A payment method is required to begin the trial, but no subscription fee is charged during the 14-day trial.
- Cancel during the trial to avoid the first $14.99 monthly charge. Access continues through the remainder of the trial.
- After the trial, Stripe charges $14.99 each month automatically until cancellation.
- Vendors may cancel at any time with no cancellation fee. Cancellation takes effect at the end of the current paid billing period, and access continues until then. Cancellation does not occur automatically at the end of a paid period unless the vendor has requested it.
- Except where required by law, monthly subscription charges already paid are nonrefundable. Failed or overdue payments may result in a limited grace period and then paused vendor access.
- We will provide advance notice of a subscription price change when required. A changed price applies prospectively and may require consent.
Subscription and cancellation controls are available through Vendor Settings and the Stripe billing portal.
8. Acceptable use
You may not misuse the service; access another user's account; submit false, unlawful, infringing, harmful, or deceptive content; interfere with security or operation; scrape or reverse engineer the service except where law permits; use the service for fraud or unauthorized payments; or harass customers, vendors, or staff. We may investigate, restrict, suspend, or terminate access for violations or safety risks.
9. FoodTrekNow intellectual property
The FoodTrekNow service, branding, software, interfaces, and original content are owned by FoodTrekNow or its licensors and protected by applicable intellectual-property laws. These Terms grant only a limited, revocable, nontransferable right to use the service as intended.
10. Third-party services
The service uses or links to third-party services, including Stripe, Supabase, hosting providers, and app stores. Their services are governed by their own terms and policies. We are not responsible for third-party services outside our control.
11. Disclaimers and limitation of liability
To the fullest extent permitted by law, FoodTrekNow is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant uninterrupted service, error-free information, or the quality, safety, legality, or availability of vendor food or operations.
To the fullest extent permitted by law, FoodTrekNow and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption. Our aggregate liability for a claim will not exceed the greater of $100 or the amount you paid directly to FoodTrekNow during the six months before the event giving rise to the claim. These limits do not apply where prohibited by law.
12. Vendor indemnity
To the extent permitted by law, a vendor agrees to defend, indemnify, and hold FoodTrekNow and its operator harmless from third-party claims arising from the vendor's food, business operations, legal compliance, content, taxes, employees or contractors, or breach of these Terms.
13. Suspension and termination
You may stop using FoodTrekNow at any time. Customers may request account deletion in Settings. Vendors must separately cancel an active Stripe subscription to stop future renewal. We may suspend or terminate access for a Terms violation, security threat, fraud, nonpayment, legal requirement, or material risk. Provisions that by their nature should survive termination will survive.
14. Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Before filing a lawsuit, you and FoodTrekNow agree to make a good-faith effort to resolve the dispute by contacting the other party. Courts with jurisdiction in Maryland will be the exclusive forum unless applicable consumer law requires otherwise.
15. Changes to the service or Terms
We may update the service and these Terms. We will update the effective date and provide additional notice when a material change requires it. Changes apply prospectively. If you do not agree to revised Terms, stop using the service and cancel any vendor subscription.
